ORDINANCE NO. 2786
AN ORDINANCE PROVIDING FOR THE VACATION OF THAT PART OF THE EAST/WEST ALLEY SITUATED BETWEEN LOTS 13-17 AND 46-50, IN BLOCK 6, TOWN OF CLINTON, AND THAT PORTION OF THE NORTH/SOUTH ALLEY SITUATED DIRECTLY WEST OF LOTS 4-8, BLOCK 6, TOWN OF CLINTON
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, IOWA:
Section 1. Purpose. The purpose of this ordinance is to vacate those portions of the described alleys (hereinafter referred to as the "ROW") and to relieve the City of Clinton, Iowa, of the responsibility for their continued maintenance and supervision as such.
Section 2. Facts Found. The City Council of the City of Clinton, Iowa, concluded upon the recommendation of the Plan Commission, and following a duly held Public Hearing that the ROW no longer serves a public purpose, that the maintenance of the ROW at public hearing is no longer justified, that the vacation of the ROW will not deny owners of abutting property reasonable access to their properties, and that the vacation of the ROW in the best interests of the City of Clinton, Iowa.
Section 3. Vacation. That portion of the 20-foot wide alley running east/west situated between Lots 13-17 and 46-50, in Block 6, Town of Clinton, and that portion of the 20-foot wide alley running north/south situated directly west of Lots 4-8, in Block 6, Town of Clinton, are hereby vacated.
Section 4. Utility Easement. The ROW, as vacated, shall be subject to easements of record as well as easements reserved for the maintenance, repair and replacement of existing utilities, as installed.
Section 5. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section 6. Repealer. Any ordinance or parts of ordinances in conflict herewith are hereby repealed.
Section 7. Effective Date. This ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
This ordinance is adopted by the City of Clinton and approved by the Mayor this 23 day of June 2026
